These Terms of Service govern the use of FOLX Publisher ("the Tool"), a software application developed and operated by:

PRIME TIME Consulting GmbH is referred to below as "we", "us" or "the Operator". FOLX Publisher is the name of the Tool in all contexts: on this website, in the connected platform developer portals, and in our internal documentation.
FOLX Publisher is an internal, server-side publishing system. It selects short-form video clips from the media library of the television channels operated by us, prepares a caption for each clip according to our editorial rules, and uploads and publishes the clip to social media accounts that we ourselves own and control — among them the TikTok account @folxtv.
The Tool runs automatically on a fixed schedule. It has no consumer-facing interface, no registration, no paid plan and no user accounts.
Use of FOLX Publisher is restricted to employees and authorised contractors of the Operator, acting within their duties. The Tool is not offered, licensed, sold or made available to the public, to customers or to any third party. Any access outside this circle is unauthorised.
The Tool may only be connected to social media accounts that belong to the Operator, and only with the express authorisation of the person entitled to control that account. Connecting the Tool to an account that the Operator does not own is prohibited.
Authorisation is granted through the login and consent screen of the platform concerned. The person granting it may withdraw it at any time in the settings of that platform or by contacting us; publishing to that account then stops immediately.
All material published through FOLX Publisher comes from the broadcast media library of the Operator's television channels. The Operator holds the necessary rights or licences for the broadcast and online use of that material.
The Tool may not be used to publish: content the Operator has no right to distribute; content that infringes intellectual property, personality or privacy rights of others; unlawful, misleading, defamatory or discriminatory content; or content that breaches the community guidelines or terms of the platform to which it is published.
When publishing through a platform's API, the Operator complies with that platform's developer terms, community guidelines and technical requirements, including rate limits and content policies. Where the platform's rules are stricter than these terms, the platform's rules apply. The Operator does not attempt to circumvent any platform restriction, quota or review requirement.
Captions are generated from clip metadata and checked against a fixed set of editorial rules before publishing. Responsibility for everything published through the Tool lies with the Operator, regardless of the fact that the process is automated. Our editorial team monitors published output and removes any post that does not meet our standards.
The Tool is provided for internal use as-is. We give no guarantee that it will be available without interruption or that every scheduled publication will succeed; platform outages, rate limits and processing failures may prevent a post from going live. Failed attempts are logged and may be repeated in a later slot.
Access credentials issued by connected platforms are stored on our servers with restricted access and are used only for the publishing purpose described in these terms and in the Privacy Policy. Credentials are never shared with third parties. Suspected compromise of a credential must be reported to the Operator immediately, and the credential is then revoked and replaced.
The Operator is liable in accordance with German law for intent and gross negligence, and for injury to life, body or health. Liability for slight negligence is limited to the breach of essential contractual obligations and, in that case, to the foreseeable damage typical of this type of agreement. As the Tool is used only internally, no liability towards third-party users arises from its use.
We may amend these terms where necessary, for example when the functionality of the Tool changes or when a connected platform changes its requirements. The current version is always published on this page with its effective date. Continued internal use after an amendment constitutes acceptance of the amended terms.
These terms are governed by the law of the Federal Republic of Germany, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Hechingen, Germany, insofar as a place of jurisdiction can lawfully be agreed.
